Les chantiers en cours sur Dogmazic :

La Radio fait son « grand » retour sur Dogmazic, avec quelques petits soucis côté serveur, mais @luciolebrillante s’y attelle avec ses petites mains. La page d’accueil aussi, a subi des améliorations. En comptant en fournir d’autres. Quelques lenteurs sont perceptibles dû au codage de la page d’accueil, et de celle d’Ampache (le logiciel multimédia, qui permet la lecture et le stockage de l’archive).

Comment faire son cd de musique libre ?

Enregistrer sa musique

Il existe dans le monde du libre des solutions alternative, souvent peu onéreuse, évidemment le matériel a toujours un coût mais on peut aussi recycler un pc en studio d’enregistrement :
voir les distributions Linux dérivées, spécialisées dans la musique ou le multimédia comme Librazik, Ubuntu Studio, Apodio, 64 studio …

et n’oubliez pas :
Jusqu'en 2003, Billyboy a enregistré ses démos avec une console Behringer et une carte son ISIS sur un Pentium 166 avec 48 Mo de RAM. Démos qui lui ont quand même permis de faire une cinquantaine de concerts par an. Inutile donc de vous jeter dans un investissement énorme si votre but est de faire des démos et que votre budget est serré. N'écoutez pas les fondus du matos qui vous disent “pas ça, c'est de la merde”. Il n'ont pas forcément tord à leur niveau ou de leur point de vue, mais avez-vous besoin de plus pour démarrer ? Ne perdez jamais de vue vos propres objectifs.

Faire presser son CD
  • La pochette

Prenez contact avec une entreprise spécialisée dans le pressage de CD, on en trouve plein dans le bottin ou sur internet.
S’ils sont sérieux, ils vous donneront les normes exactes à respecter pour votre pochette : formats des fichiers à fournir, gabarits, etc …
Je ne vous cacherai pas que faire une pochette c’est un métier ! si vous avez un graphiste sous la main passez lui un coup de fil !
Si vous le faites tout seul, bonne chance …
Gimp et Scribus seront vos amis.

Il faut entre autre :
– penser à utiliser une définition de 300 dpi (point par pouces ? je crois), ça veut dire une bonne définition d’image
– faire attention à l’ordre des pages du livret
– faire attention aux marges qu’on vous donnera, prenez toujours un peu plus (d’expériences … ratées)
– utiliser des formats de couleurs CMJN, c’est à dire en quadrichromie
– pour le rond CD, si vous utiliser 1 ou 2 couleurs faites attention au format de l’image, on peut vous demander d’utiliser une couleur particulière pour les tracés

  • Mentions obligatoires

ah ! les Mentions obligatoires, voila qui est très intéressant !
Sachez qu’en tant que militant du libre, vous n’êtes soumis qu’à 2 d’obligations : le logo Compact Disc, et le logo PAI (ou DP).

Attention à bien expliquer votre démarche et la licence que vous utilisez à la boite de pressage à qui vous vous adressez, s’ils n’ont pas l’habitude, ils vous demanderont d’appliquer toutes les mentions obligatoires pour les adhérents de la SACEM, ou appliqueront eux même les divers logos Sacemiques et autres “Tous droits réservés …”.

Le logo Compact Disc peut vous être fourni, sinon vous le trouverez sur le web.
Le logo PAI “Propriétaire Actuellement Inconnu” signifie que vous n’êtes pas connu de la SACEM. Ce logo n’existe pas vous pouvez créer le votre ou jeter un œil à ceux sur Dogmazic :

Bien sur il faut préciser le type de licence libre que vous avez choisi, mettre un joli logo CC ou autre ainsi qu’une référence au contrat choisi.
N’oubliez le nom du groupe et le titre du CD, ça se fait.
Dans le cas DP, Domaine Public, vous pouvez aussi créer votre logo il n’existe pas non plus.

  • Demande SDRM

C’est la société de Reproduction des Droits Mécanique chez qui vous devez déposer obligatoirement une demande de pressage, avec le nombre d’exemplaires, s’ils sont destinés à la vente, à la promotion, bref un tas de détails liés au CD lui-même. Cette démarche permet à la SACEM de calculer les droits que vous devez payer si vous utilisez des morceaux de membres. Par exemple si vous avez eu la bonne idée d’adhérer à la SACEM et que vous faites une demande de pressage pour votre CD avec vos chansons, vous vous retrouvez à payer des droits de reproduction sur votre propre CD … En musique libre, votre demande sera examinée sous quinzaine et si tout est correct, on vous demandera la modique somme de 0 euros pour avoir le droit de presser votre CD.

Licence Musique Libre – et son texte légal

Bonjour !

Voici à nouveau un article sur les licences libres utilisées aujourd’hui (ou dans le passé) sur l’archive Dogmazic. Si vous avez déjà vu un de ces articles, alors vous savez que leur but est en premier lieu de sauvegarder ces licences. En deuxième lieu, de les présenter (voire exhumer 😉 ) au grand jour !

Oui, « sauvegarder ». Les artistes qui publient leur musique sur Dogmazic peuvent choisir entre de nombreuses licences, et il nous a semblé judicieux de s’en assurer une copie sur nos propres serveurs, afin de ne pas dépendre des aléas du net. C’est important de ne pas compter éternellement sur des supports externes…

…et la Licence Musique Libre qui est l’objet de cet article en est un très bon exemple 🙂 nous savions qu’elle existait, puisque nous en trouvions trace dans nos tableaux résumant les licences utilisées sur Dogmazic (comme celui-ci), mais ??? ensuite ??? elle était devenue complètement introuvable…
Votre humble serviteur s’est pourtant démené dans le web référencé ET le web non-référencé, en utilisant des sites comme archive.org mais aussi des équivalents du monde entier (y compris un site d’archivage du net chinois) ! Que nenni ! Liens morts, liens morts, partout des liens morts ! Une hécatombe !
C’est seulement en s’y mettant à plusieurs, avec la précieuse aide (et mémoire) de Aisyk notamment que nous avons pu ENFIN retrouver cette licence. Et ce n’est pas étonnant que ç’ait été difficile : elle n’était initialement hébergée (semble-t-il) qu’en un unique point du net, qu’il fallait connaître.
Mais j’arrête là cette saga, c’est un article sur la licence, pas sur son hébergement. Vous avez compris : nous avons été d’autant plus stimulés pour faire une sauvegarde de notre côté.

Alors, cette licence ?

La Licence Musique Libre est la licence du groupe Miss Helium, un groupe punk engagé qui jouait principalement dans les années 2000. Elle date de 2004 en version 1.0. Elle confère la liberté de copier, diffuser, représenter, échantillonner, mixer et incorporer tout ou partie de l’œuvre. Ce n’est pourtant pas une CC-BY ! Il y a une clause spéciale :

« L’incorporation de l’œuvre avec un support visuel (film, reportages, spectacles, …) est soumise à l’autorisation des auteurs. »

Donc voilà, une licence de libre diffusion à l’exception des supports visuels (on peut penser à la publicité) qui ne sont pas exclus, mais qui exigent l’autorisation des auteurs.

Licence Musique Libre

1. Objet

Cette licence a pour objet de définir les conditions selon lesquelles vous pouvez jouir librement de cette œuvre.

2. Étendue de la jouissance

Cette œuvre est soumise au droit d’auteur, et l’auteur par cette licence vous indique quelles sont vos libertés pour la copier, la diffuser, la modifier et l’incorporer. Toute utilisation sortant du cadre de cette licence est soumise à l’autorisation des auteurs.

Vous pouvez diffuser librement les copies de cette œuvre, modifiées ou non,
– sur une radio, hertzienne ou par internet, qu’elle soit commerciale ou non, en citant si possible le nom des auteurs (Miss Hélium) et le site internet sur lequel on peut télécharger cette œuvre (wwww.diogene.ch)
– par haut-parleur dans n’importe quel lieu public ou privé, commercial ou non.

2.3 La liberté de modifier, d’échantillonner, de mixer

Vous avez la liberté, dans le respect des conditions prévues à l’article 2.1 et 2.2 en cas de diffusion (ou représentation) de la copie modifiée,
– de modifier les copies des originaux, qui peuvent être partielles ou non.
– d’échantillonner (sampling) une partie de l’œuvre
– de mixer cette œuvre, en totalité ou partie, avec n’importe quelle musique ou instrument de musique.

3. L’incorporation de l’œuvre

Vous avez la liberté d’incorporer cette œuvre dans votre propre œuvre, dans le respect des conditions prévues à l’article 2.1, 2.2, et 2.3 en cas de diffusion (ou représentation) de la copie modifiée. L’incorporation de l’œuvre avec un support visuel (film, reportages, spectacles, …) est soumise à l’autorisation des auteurs.

4. La durée de la licence

Cette licence prend effet dès votre acceptation de ses dispositions. Le fait de copier, de diffuser ou de modifier l’œuvre constitue une acceptation tacite.
Cette licence a pour durée la durée des droits d’auteurs attachés à l’œuvre. Si vous ne respectez pas les termes de cette licence, vous perdez automatiquement les droits qu’elle vous confère.
Si le régime juridique auquel vous êtes soumis ne vous permet pas de respecter les termes de cette licence, vous ne pouvez pas vous prévaloir des libertés qu’elle vous confère.

5. Les différentes versions de la licence

Cette licence pourra être modifiée régulièrement, en vue de son amélioration, par ses auteurs, sous la forme de nouvelles versions datées et numérotées. La version valable est celle en vigueur (sur www.diogene.ch) à la date ou vous copiez, diffusez ou modifiez cette œuvre.

6. La loi applicable au contrat

Cette licence est soumise au droit français.

Nouvelles de l’archive Dogmazic

Bonjour,
auditrices, auditeurs, musiciens et musiciennes conviés sur Dogmazic, pour commencer cette année voici deux bonnes nouvelles de l’archive:
    
La première, c’est que Aisyk a pu récupérer les droits d’accès au serveur ! Une personne de plus avec les accès, cela signifie plus de souplesse, de réactivité et d’indépendance pour la gestion des problèmes techniques de l’archive. Vous vous en doutez, c’est une très bonne nouvelle 😉
La deuxième, qui est une conséquence directe de la première, c’est que l’accès SSL au site est de nouveau opérationnel, merci à Aisyk et à Florian de s’en être occupé, lors d’un contrib’atelier 🙂
Donc il est de nouveau possible de se connecter au site de manière sécurisée, avec https, qui est une version sécurisée (chiffrée) du http. Ce qu’on vous recommande: une connexion chiffrée égale plus de difficulté à une tierce personne d’intercepter vos données personnelles, égale plus de sécurité.*
Pour le moment la connexion non-chiffrée « http » reste possible, en attendant que l’équipe technique mette en place une règle pour forcer la connexion chiffrée ! Si vous accédez au site par exemple depuis votre historique de la barre d’adresse, à moins de taper « https:// » devant dogmazic.net, votre connexion pour le moment restera en http « de base ». 
C’est ainsi que s’était terminée 2018 chez Dogmazic, et que se termine cette petite breaking news pour l’archive.

Comment déclarer mes revenus issus de la musique ?

Nous pouvons penser à pas mal de statuts, d’auto-entrepreneur à star du taupe 50, salarié d’une association ou d’une entreprise d’édition…

Quelle situation ?

Si vos sources de revenus sont composées de :

  1. Royalties (youtube, spotify, etc.), droits d’auteur, et donations
  2. Ventes de licence avec et sans intermédiaire (pour des projets musicaux, des publicités par exemple…)
  3. Concerts : même s’ils sont rares
  4. Ventes de musique (CD et numérique) et de partitions (Papier et numérique)

Des solutions !

Pour tout ce qui relève des royalties et droits d’auteurs, ce sont les BNC (bénéfices non commerciaux) : https://www.service-public.fr/professionnels-entreprises/vosdroits/F31984
Vous devrez déclarer ces revenus dans cette case. Attention toutefois, il existe des plafonds de revenus au delà desquels vous paierez plus d’impôts.
Pour les ventes de produits et services, souvent les statuts diffèrent. Parfois c’est une association des amis de l’artiste qui gère cela pour un auteur, parfois ce sont des statut d’auto-entrepreneur, ou d’indépendant.

À savoir, ce n’est pas spécifique aux artistes libres, bien entendu, mais cela répond, je pense, à la plupart des questions. En fait, tout dépend du plafond que vous allez dépasser (ou pas) sur ces revenus.

Licence creative commons Sampling Plus 1.0 – TEXTE LÉGAL

Vous vous souvenez de ces articles visant à sauvegarder les textes légaux des licences utilisées et proposées sur Dogmazic ? En voici un nouveau 😉

Dans la lignée des licences Creative Commons peu connues, voici la Creative Commons Sampling Plus 1.0.
C’est un exemple intéressant de la souplesse que permettent les licences libres:

En résumé, vous êtes libre d’échantillonner (sampler), faire des mash-ups ou transformer l’œuvre d’une autre manière créative pour des buts commerciaux ou non-commerciaux.
MAIS de la performer, d’afficher et distribuer des copies de l’œuvre entière pour des buts non-commerciaux seulement.

Le tout sous les conditions suivantes:

  • Vous n’avez pas le droit d’utiliser cette œuvre à des fins publicitaires ou de promotion autres que celles destinées à l’œuvre que vous créez à partir d’elle.
  • Vous devez indiquer l’auteur de l’œuvre ou le titulaire des droits (mais pas d’une manière qui suggérerait qu’ils vous approuvent, vous ou votre utilisation de l’œuvre)
  • Et laisser clairs et explicites les termes de la licence pour toute redistribution (par exemple via un lien vers la page Sampling Plus sur le site Creative Commons).

P’tite pub gratuite

D’temps en temps, faire dans l’binaire (textes, musiques, insultes…) a le mérite de débloquer vos synapses maltraités par un ministre qui vous pourrit l’intérieur. Suite à cette pratique honteuse mais véritable remède de choc, vous pourrez vous replonger dans l’écoute de l’interprétation magistrale des Variations Goldberg de Bach par Glen Gould.

Miss Hélium sévit autant dans les caves punk que dans les freeparties, soirées diverses (rock, techno, métal, industriel) parfois militantes, manifestations de rue (anti-G8-Bush-LEN…), festivals… Près de 200 concerts dont une centaine en France, mais aussi en Suisse, Belgique, Hollande, Allemagne, Pologne…

S’inscrivant dans le mouvement des arts et des logiciels libres, Miss Hélium se refuse de devenir membre de la Sacem. Sa musique est sous licence musique libre, cela signifie que l’intégralité des morceaux sont téléchargeables gratuitement sur internet.

Licence Developing Nations 2.0 – texte légal

Bonjour !
Une des licence proposée (ou plutôt ayant été proposée) sur Dogmazic ! C’est une licence initialement de 2004 dont le texte légal peut être sauvegardé ici. J’ai nommé, la licence: Developing Nations 2.0

Comme écrit plus haut, la licence Developing Nations 2.0 a été proposée sur Dogmazic, mais désormais elle est déconseillée par Creative Commons – qui recommande de ne pas l’appliquer aux oeuvres. Or je vous propose ici quelques traductions en français, d’articles postés en 2004 et 2007 sur le blog de Creative Commons, pour comprendre les idées véhiculées par cette licence.


    Aujourd’hui, Creative Commons lance une nouvelle licence, appelée Developing Nations. Le résumé est simple: c’est une licence attribution-seulement qui s’applique au sein des pays en voie de développement. Son code légal définit un pays en voie de développement comme « toute nation qui n’est pas classifiée comme une ‘high-income economy’ (NDLT: pays à revenus élevés) par la Banque Mondiale. » ce qui, suivant le site de la Banque Mondiale, signifie qu’elle ne s’applique pas dans cette liste de pays.
    La licence peut être utilisée de plusieurs manières différentes. Elle peut être combinée avec une oeuvre actuellement sous une licence plus restrictive: vos photographies peuvent être protégées d’utilisation commerciale aux États-Unis, mais en y combinant une licence Developing Nations, les mêmes photos pourront être utilisées commercialement, par exemple, au Brésil. Vous pourriez aussi être un musicien ou un photographe qui veut maintenir un copyright complet en Amérique du Nord et en Europe de l’Ouest, mais encourager l’usage de ses oeuvres dans des pays d’Asie du Sud-Est.

    Ajourd’hui nous retirons deux licences Creative Commons – la licence Developing Nations, ainsi que une des trois licences Sampling que nous proposons. Les raisons de ces retraits sont à la fois pratique et de principes.

La raison pratique est un simple manque d’intérêt: depuis le début, Creative Commons a promis de garder notre famille de licences aussi simple que possible. La demande actuelle a été un des indicateurs clés, montrant combien les choses peuvent être simples. Nous estimons à seulement 0.01% de nos licences les oeuvres sous Developing Nations, et 0.01% sous la version de la licence Sampling que nous retirons. Ces nombres parlent d’eux-même: il n’y a pas de demande pour ces licences.

Les raisons de principes sont différentes pour chaque licence. La licence Developing Nations est en conflit avec le mouvement en plein essor « Open Access Publishing » (NDLT: publications en accès libre). Car bien que les licences libérent le travail créatif dans ls pays en voie de développement, elles ne le libèrent pas, d’aucune façon, ailleurs. Cela signifie que ces licences ne remplissement pas les standards minimum du mouvement Open Access. Parce que ce mouvement est si important pour la propagation de la science et du savoir, nous ne pensons désormais plus comme correct de promouvoir une pareille version autonome de cette licence. Plus tard ce mois-ci, nous débuterons une discussion à propos de l’ajout des termes de la licence Developing Nations à 5 des autres licences CC. (Donc par exemple vous pourriez choisir une licence BY-NC pour les pays développés, mais offrir une licence BY pour les créateurs dans les Pays en voie de développement.) Parce qu’une telle option serait en lien avec une licence CC standard, elle ne serait plus en conflit avec les principes que nous avons énoncés ici.

Statement of Purpose
